Splitting Payment from Employer with Client Who Self-Services

I seek clarification on a matter related to home care assistance for elderly or disabled individuals.

In some cases, elderly clients receive approval for home care services that are paid for by a home care company. The assistant or nurse, who may sometimes be a relative (e.g., a nephew), is assigned to help the elderly person with daily tasks and needs. However, sometimes the elderly person can manage certain tasks independently and requests that the assistant perform only minimal duties. As a result, the elderly person proposes that since they are absolving the assistant from some of their duties, the assistant should share a portion of the payment received from the home care company with them.

Is it permissible for the assistant to share the payment in this manner, considering that the home care company is not directly paying for specific tasks, but rather for general assistance? Would such an arrangement be compliant with Sharia?

An individual who has been hired to provide their service in a particular time is termed an ajīr khāṣṣ. An employee of such a nature deserves their wage by merely making themselves available during the fixed time.^[1] Therefore, in the scenario you have provided, the assistant deserves the full payment, even if the client opts to perform some of the tasks themselves.

Furthermore, such financial arrangements may violate the caretaker's contract with the home care company.
